Conciliation and mediation


Mediation and conciliation are considered as alternative modes of dispute settlement in which a third party intervenes with the parties to help them resolve the dispute between them.

Mediation is considered as an alternative mode of dispute settlement in which a third party intervenes with the parties to help them resolve the dispute between them.


The issue is not to decide the case as a judge or an arbitrator would do, but to find an amicable solution.
  
When issuing his arbitration award, the arbitrator allows the parties to obtain a compulsory and binding decision, comparable to a court decision.

   
Mediation, in turn, allows the parties to contribute with the help of mediators in developing the transaction they will only sign if satisfied with it.
 
The mediator, in fact, cannot impose his own solution, having no authority, except that of inviting the parties to the mediation session

  • Conciliation​

Conciliation consists in the intervention of a third party, the conciliator, who after listening to the parties and analyzing their views offers them a way of resolving their dispute 

​CACI and its Center for Conciliation, Mediation and Arbitration provide parties a mediation and conciliation service to which they can appeal by a written referral to organize the proceedings.
